Welcome to PhotoHero.AI. These Terms of Service (“Terms”) govern your access to and use of the PhotoHero.AI website, applications, and services (collectively, the “Services”). The Services are operated by PhotoHero.AI (“PhotoHero.AI,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using PhotoHero.AI, you represent that you have the legal capacity to enter into a binding agreement.

PhotoHero.AI provides artificial intelligence tools that allow users to generate, edit, and transform images, videos, and other media using uploaded content and prompts.

Features may include AI image generation, editing tools, marketing asset creation, face swap tools, and other media processing capabilities.

We may update, modify, or discontinue features at any time.

4. User Content

You may upload images, videos, prompts, and other materials (“User Content”) to the Services.

You retain ownership of your User Content. However, by uploading content, you grant PhotoHero.AI a limited, non-exclusive license to host, process, store, and display the content solely for the purpose of operating and improving the Services.

You represent and warrant that:

• You have the legal rights to upload and use the content
• The content does not violate any laws or third-party rights
• The content does not infringe copyright, trademark, publicity, or privacy rights

Likeness and Consent

If your content contains identifiable individuals, you represent and warrant that you have obtained all necessary rights, permissions, and consent from those individuals to upload, modify, and generate derivative content using their likeness.

You may not use the Services to create or distribute content that falsely represents a real person or impersonates someone without authorization.

5. AI-Generated Content

The Services may generate images, videos, or other outputs based on your inputs (“Generated Content”).

Because AI systems are probabilistic:

• Generated Content may not be unique
• Similar outputs may be generated for other users
• PhotoHero.AI does not guarantee accuracy or suitability of generated content

You are responsible for how you use Generated Content.

PhotoHero.AI does not verify whether Generated Content infringes third-party rights. Users are responsible for ensuring their use of generated material complies with applicable laws and rights.

6. Prohibited Uses

You agree not to use the Services to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Create misleading, harmful, or fraudulent content
• Impersonate individuals without consent
• Create deceptive deepfakes intended to mislead others
• Generate abusive, defamatory, or illegal content
• Upload content involving minors in inappropriate contexts
• Interfere with the operation or security of the platform

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Payments and Credits

Certain features of the Services require payment.

Subscriptions. If you purchase a subscription, you agree to recurring billing until canceled. Cancellation stops future billing but does not refund the current billing period.

Credit Packages. Some services may require credits for AI generation or rendering.

• Credits have no cash value
• Credits are non-refundable once used
• Credits may expire if specified at purchase

Consumption of Digital Services

Credits are used to access computational resources required to generate or process media using our AI systems. Once a generation, rendering, or processing task has been initiated or completed, the associated credits are considered consumed digital services and cannot be refunded.

Due to the immediate consumption of computing resources, completed generations or processing tasks are not eligible for refunds, except where required by law.

All purchases are subject to our Refund Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The PhotoHero.AI platform, including software, design, branding, and technology, is owned by PhotoHero.AI and protected by intellectual property laws.

You may not:

• Copy or reverse engineer the platform
• Resell or redistribute the Services
• Use our branding without permission

9. Service Availability

We strive to keep the Services available but do not guarantee uninterrupted access. The platform may experience maintenance, outages, or technical issues.

We may modify, suspend, or discontinue parts of the Services at any time.

10. Termination

We may suspend or terminate your account if you violate these Terms or use the Services in a way that poses risk to PhotoHero.AI or other users.

You may stop using the Services at any time.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, PhotoHero.AI disclaims all warranties, including:

• merchantability
• fitness for a particular purpose
• non-infringement
• accuracy or reliability of generated content

12. Limitation of Liability

To the maximum extent permitted by law, PhotoHero.AI shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Services.

Our total liability for any claim related to the Services will not exceed the amount you paid to PhotoHero.AI in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless PhotoHero.AI from any claims, damages, liabilities, or expenses arising from:

• your use of the Services
• your User Content
• your Generated Content
• your violation of these Terms

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. If significant changes are made, we will update the Effective Date and may notify users through the Services.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
